What is this case about?

The Office of the Attorney General for the District of Columbia reached a settlement with B&B Solutions and its subcontractors, MJ Flooring, Ana’s Cleaning and Compliance Construction Remediation, over allegations that they violated District of Columbia wage-and-hour-laws by paying workers less than the minimum wage and not providing required sick leave.

Who can file a claim form?

If you are a janitorial worker who was subcontracted to work for B&B Solutions through one of its subcontractors, MJ Flooring, Ana’s Cleaning, or Compliance Construction Remediation, to provide emergency COVID-19 cleaning services in the District of Columbia from March 20, 2020 to May 2022, you may be eligible for a share of a settlement fund.

You can file a claim form online by June 28, 2024.

You can also submit a paper claim form by mail or email.  Claim forms can be requested from the Claims Administrator or downloaded from the website.

What does the Settlement provide?

B&B and Ana’s Cleaning paid $657,000 to the District, of which $492,000 can be used to provide restitution to janitorial workers who worked for B&B’s subcontractors in DC.

 

The companies also paid $165,000 in civil penalties to the District and will implement improved compliance measures.

How do I get a settlement payment?

To ask for a settlement payment, you must complete and submit a Claim Form online by June 28, 2024.

You can also submit a paper claim form by mail or email.  Claim forms can be requested from the Claims Administrator or downloaded from the website.

The Claims Administrator will initially decide whether the information provided on a Claim Form is complete and valid.  Additional information may be requested from any claimant.  If the required information is not provided in the time required, the claim will be considered invalid and will not be paid.

Please note, if you owe taxes or child support to the District, your refund will be used to pay your debt. Before the OAG authorizes any payments to an eligible claimant, the D.C. Office of the Chief Financial Officer shall determine whether the claimant owes any amount to the District and will deduct the amount owed from the award to the claimant, if any. See D.C. Code § 1-301.86c(d).

When can I file a claim form?

You can file a claim from now through June 28, 2024.

How much will my settlement payment be?

We don’t yet know how much settlement payments will be. This may depend on the number of claims filed.
